Main duties:
1. With authorization of the Shenzhen Municipal People's Government, fulfill State-owned assets investor duties under the Company Law of the People's Republic of China, the Law of the People's Republic of China on State-owned Assets in Enterprises and other regulations of the municipal government; draw up local laws, regulations and policies on enterprise State-owned assets supervision, develop an operating State-owned assets supervision system and methods, and implement them upon approval.
2. Guide Party building in supervised enterprises, Shenzhen-based State-owned enterprises and related collective-owned enterprises.
3. Supervise the value preservation and increment of State-owned assets of supervised enterprises; establish and improve an index system of value preservation and increment of State-owned assets, and formulate evaluation standards; supervise and administer the value preservation and increment of State-owned assets of supervised enterprises through budget control, property right regulation, auditing and examination; safeguard the rights and interests of State-owned assets investors; urge supervised enterprises to fulfill social responsibilities.
4. Coordinate the reform of State-owned enterprises; guide and serve the reform of municipal State-owned enterprises; carry out research on the management system of State-owned assets and enterprises, and advise on the reform and development of State-owned assets and enterprises; research and draw up reform and development plans for supervised enterprises to promote the reform and restructuring of State-owned enterprises and propel the strategic adjustment of the layout and structure of State-owned economy; guide district State-owned assets supervision under the law.
5. Take responsibility for the property right delimitation, registration and alteration, general checkup on the fixed assets, supervision and assets assessment and management of the State-owned assets of supervised enterprises; supervise and regulate State-owned property right trading; examine the management guidelines, investment plans, property right transfer, State-owned stock right management and major asset disposal of supervised enterprises; guide and propel supervised enterprises to implement the production safety responsibility system.
6. Take responsibility for the construction of the leading group, the personnel and the backup team of supervised enterprises; guide and propel supervised enterprises to perfect the modern enterprise system with Chinese characteristics, improve their corporate governance structure, facilitate the construction of their board of directors and board of supervisors, and implement the chief representative report system in State-owned property to form a governance mechanism featuring explicit responsibilities, coordinated operation and effective balance.
7. Improve the corporate leader selection and appointment mechanism that meets the requirements of the modern corporate system; appoint, recommend, or remove leaders of supervised enterprises through legal procedures; appoint or recommend directors, supervisors and chief financial officers to supervised enterprises; carry out annual evaluation and decide rewards and penalties on their performance during their tenure.
8. Develop an operating budget management system and methods for municipal State-owned capital; draft the budget and final accounts of State-owned capital and perform budget enforcement under related regulations; organize supervised enterprises to implement overall budget management and hand over gains from State-owned capital.
9. Manage revenue distribution of supervised enterprises; draft and implement reform guidelines on corporate revenue distribution; regulate the income distribution and position-related consumption of supervised enterprises’ responsible persons; improve the incentive and constraint mechanism of corporate leaders.
10. Formulate policies for collective-owned assets management; guide the reform and development, transformation and upgrading, business operation and talent training of collective-owned enterprises (including community-owned joint-stock companies); propel the value preservation and increment of collective assets.
11. Complete other tasks assigned by the CPC Shenzhen Municipal Committee, Shenzhen Municipal People's Government, and superior authorities.
12. Transformation of functions
(1)Strengthen overall coordination and services. In accordance with the decisions and arrangements made by the Central, provincial, and municipal authorities on the reform and development of State-owned enterprises, comprehensively advance regional State-owned asset and enterprise comprehensive reform trials. Enhance the overall coordination of the city's work on the reform and development of State-owned assets and enterprises, strengthen supervision, management, and services for municipal State-owned enterprises, reinforce guidance and supervision of district State-owned assets regulatory departments, promote the preservation and appreciation of State-owned capital, effectively prevent the loss of State-owned assets, build up the strength, quality and size of the city's State-owned enterprises, and cultivate world-class enterprises with global competitiveness.
(2)Accelerate the transformation from primarily managing enterprises to primarily managing capital. Drive the transformation of regulatory functions towards capital management, industry layout, structural adjustments, resource allocation, and inspection and supervision. Strengthen responsibilities in reviewing the core businesses, development strategic planning and annual comprehensive budget management of regulated enterprises, and focus on managing State-owned capital allocation, regulating capital operations, enhancing capital returns, and safeguarding capital security.
