Acceptance requirements
A foreign-invested joint stock limited company maymake a filing when all of the following conditions are met:
1. There is an alteration in the company’s registration items;
2. Where the filing of the company’s items must be reported for approval in accordance with the law, administrative regulations and decisions of the State Council, and has been approved by the relevant licensing authorities;
3. If the company’s filing item is on the list of the Special Administrative Measures for the Access of Foreign Investment (Negative List)or involves foreign-funded mergers and acquisitions, and the approval from the approval authority has been issued, and
4. A resolution or decision has been made by the foreign-invested joint stock limited company in accordance with the law.
